Privacy policy

As the operator of the NOCK website, NOCK Maschinenbau GmbH (hereinafter referred to as "NOCK") takes the protection of personal data very seriously. NOCK wants you to know which data is collected when and how it is used by NOCK. Through technical and organisational measures, NOCK ensures that the regulations regarding data protection are observed both by NOCK itself and by the external service providers working for NOCK.

All web activities by NOCK are carried out in accordance with the applicable legislation according to GDPR for the protection of personal data and for data security.

Personal data that you provide when you visit our NOCK website is processed in accordance with the provisions of the General Data Protection Regulation (GDPR), the German Data Protection Act (BDSG) and other legal provisions that apply to electronic business transactions.

Purposes and legal bases of processing data:
Your data is collected on the basis of article 6 para. 1 subparagraphs b, c and GDPR in conjunction with:

2. Categories of personal data being processed

NOCK processes the following personal data from you:

  • Contact details (name, address, e-mail address, telephone number, fax number)
  • Bank account details (account number, bank code (IBAN))

Recipients or categories of recipients of the personal data:
Your personal data is passed on to:

  • (recipient within the company): sales department, marketing department, accounting, personnel department
  • (processor): tax office, IT service provider
  • (third parties): trading partners in Germany and abroad, internet service providers: Google Maps and YouTube.

Since we usually sell our products through trading partners, we may pass on your data to our respective trading partner for this purpose. Our trading partners are companies of the food processing machine trade and service companies for food processing machines.

We also use your data to provide you with information related to your inquiry (such as new developments for your application) in the future unless you revoke your consent.

3. Transfer of personal data to a third country

We do not intend to transfer your personal data to a third country or an international organisation.

However, we have set up links on our homepages that refer to data stored on “non-company servers" that may be located in a third country. To use these services (Google Maps and/or YouTube), you must first give your consent. You do this by confirming the highlighted text.

Upon confirmation you leave our website and are then on the servers of the respective service provider. There, the privacy policy of the service provider applies.

On 27 April 2016, the EU Commission decided that personal data is protected in recognised third countries in the same way as in the European Union.

4. Storage duration of personal data

After collection, your data is stored at NOCK for at least as long as is required under the statutory retention periods set out in the German Commercial Code (sections 238 and 257 HGB) and the German Tax Code (section 147 AO) for the fulfilment of the respective task.

Received and sent business correspondence, commercial documents and other documents of commercial and tax significance for at least six years pursuant to section 257 para. 1 Nos. 2 and 3 HGB.

Accounting vouchers according to section 238 para. HGB, incoming and outgoing invoices according to section 14b of the German Turnover Tax Law for at least 10 years.

5. Data subject rights

Under the EU General Data Protection Regulation, you have the following rights:

If your personal data is processed, you have the right to obtain information about the data stored about you (Art. 15 GDPR).

If incorrect personal data is processed, you are entitled to a correction (Art. 16 GDPR).

If the legal prerequisites exist, you can request the deletion or limitation of the processing and object to the processing (articles 17, 18 and 21 GDPR).

If you do not provide the required data

  • your order cannot be processed;
  • we cannot conclude the contract with you.

If you have consented to the data processing or if a data-processing contract exists and the data processing is carried out using automated procedures, you may be entitled to data portability (article 20 GDPR).

If you make use of your rights as mentioned above, NOCK will check whether the legal requirements for it have been met.

Furthermore, you have the right to lodge a complaint with the Baden-Württemberg commissioner for data protection and freedom of information.

6. Right of revocation of consent

If you have consented to the processing of your data by NOCK through a corresponding statement, you can revoke this consent at any time with effect for the future. The revocation of consent does not affect the legality of the data processing carried out based on the consent before its revocation.

7. Duty of provision of the data

NOCK needs the data to process your inquiry and to be able to conclude the contract with you.

  • your inquiry cannot be processed;
  • we cannot conclude the contract with you

8. Special case: Duty to inform in the event of a later change of purpose

NOCK does not intend to change the purpose for the data collected from you.

9. Special case: Automated decisions in a particular case including profiling

NOCK does not use any automated decision-making/profiling procedures that have any legal effect on you or significantly affect you in a similar manner.
